Terms of Service

1. Acceptance

By creating an account or using kAIvira (“the service”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.

2. The Service

kAIvira is a real-estate search platform operated by Robbie Sands, a licensed real-estate professional in Tennessee. Listing data is sourced from the Spark MLS (East Tennessee Realtors) and is believed accurate but is not guaranteed. Always verify details with your real-estate agent before making decisions.

3. Account & Eligibility

• You must be at least 18 years old to create an account.
• You are responsible for keeping your password secure and for all activity under your account.
• One person, one account. Do not impersonate anyone else.
• We may suspend or terminate accounts that abuse the service, violate these Terms, or harm other users.

4. Acceptable Use

• Do not scrape, resell, or redistribute MLS data. Listings are for personal, non-commercial use.
• Do not send automated requests, attempt to bypass rate limits, or interfere with other users’ access.
• Do not use the service for any unlawful purpose or to harass others.

5. SMS Messaging Program Disclosures

Program name

kAIvira Alerts.

Description

kAIvira sends account notifications, property-alert updates (new listings matching your saved searches and price-drop alerts on favorited homes), one-time passwords for phone verification, and replies from Robbie Sands in response to inquiries you initiate through the site.

Message frequency

Message frequency varies. You will typically receive no more than a few messages per week, depending on how often listings in your saved searches change.

Message and data rates may apply. Check your wireless plan for SMS rates — they vary by carrier.

How to opt out

Reply STOP to any message to unsubscribe. You will receive a single confirmation message and no further texts from that program. You can also disable SMS notifications from within your account settings.

Carriers

Supported on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Consent

By opting in (checking the SMS consent box during onboarding or enabling SMS in your account settings), you expressly consent to receive text messages from kAIvira at the mobile number you provide, including messages sent using an automated system. Consent is not a condition of using the service. Your phone number will not be shared or sold to any third party for marketing purposes — see our Privacy Policy.

6. Listings & Real-Estate Information

• Listing information is provided by third-party MLS sources and may be out of date or inaccurate.
• kAIvira is not a brokerage and does not list, show, or sell homes as a principal.
• Property photos, descriptions, and data are the property of their respective listing parties.
• Always verify critical details (price, status, tax, HOA, school zoning) with a licensed professional.

7. Intellectual Property

The kAIvira name, logo, design, and codebase are owned by Robbie Sands. You may not copy, modify, or distribute any part of the service without permission. Listing data remains the property of the originating MLS and its participants.

8. Disclaimers

The service is provided “as is,” without warranties of any kind. We do not guarantee the accuracy of listings, continuous availability, or that the service will meet your specific needs. Use of the service is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, kAIvira and Robbie Sands will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising out of these Terms will not exceed the greater of $100 or the amount you paid us in the past 12 months.

10. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Knox County, Tennessee.

11. Changes

We may update these Terms from time to time. Material changes will be announced by email or on the site. The “Effective” date above reflects the most recent update. Continued use after a change means you accept the new Terms.
